1. Acceptance of Terms
These Terms of Service govern your access to and use of the Raiko IT LLC website and your engagement of Raiko IT LLC for services. By accessing our website, requesting or authorizing services, accepting a quote or invoice, or otherwise engaging Raiko IT LLC, you acknowledge that you have read, understood, and agree to be bound by these Terms.
These Terms apply to all services provided by Raiko IT LLC unless a separate written agreement, statement of work, or contract expressly states otherwise.
2. Eligibility
Our services are available to individuals and businesses. We reserve the right to refuse service at our discretion.
3. Description and Scope of Services
Raiko IT LLC provides information technology services including managed services, on-demand support, project-based work, and consulting. Services may include network administration, hardware installation, system configuration, troubleshooting, migrations, and related IT support.
Services may be delivered remotely or on-site as determined by Raiko IT LLC, in coordination with the client. Work is scheduled in collaboration with clients and may require advance planning depending on scope, availability, and business impact.
Services are limited to the scope approved by the client. Project work requiring payment is performed only after approval of a written quote. For ongoing clients, authorization may be provided by designated points of contact approved by the client at the start of services, including via email.
Changes to systems may have unintended effects, and rollbacks may not always be possible. Clients acknowledge that IT environments are interconnected and that modifications, updates, or migrations may impact related systems or services.
Clients are responsible for providing timely access, credentials, and information necessary for Raiko IT LLC to perform services. Delays in providing required access may delay or prevent completion of work.
Raiko IT LLC may assist with security and compliance-related efforts, including industry-specific requirements such as HIPAA, but does not provide legal advice or guarantee regulatory compliance. Compliance outcomes depend on client cooperation and adherence to recommended configurations and practices.
4. Services and Best-Effort Commitment
Raiko IT LLC is committed to providing high-quality, professional IT services and will make reasonable, best-effort attempts to diagnose, repair, configure, and maintain systems entrusted to us.
While technology is constantly evolving and no system can be guaranteed to be entirely free from failure or security risk, we take our responsibilities seriously and work diligently to resolve issues in a timely and thorough manner.
Any guarantees or warranties provided by Raiko IT LLC will be clearly documented in writing and apply only to the specific services or equipment described in that written agreemen
5. Repair and Workmanship Guarantee
For devices or systems serviced directly by Raiko IT LLC, we provide a one hundred twenty (120) day workmanship guarantee on the specific issue addressed.
If a client retrieves a device and the originally serviced issue has not been resolved, the client may return the device within the guarantee period and Raiko IT LLC will continue work on that issue at no additional labor cost.
This guarantee applies only to the original problem addressed and does not cover new, unrelated issues, physical damage, misuse, or changes made by third parties after service completion.
6. Data, Backups, and Client Responsibilities
Raiko IT LLC recognizes the importance of data protection and, when explicitly agreed upon in writing, will design, implement, and maintain backup systems in accordance with an agreed-upon backup plan.
When Raiko IT LLC is responsible for administering backups, we will make reasonable efforts to ensure backups are functioning as designed, provided the client follows the agreed-upon backup plan, including hardware, software, access, and storage requirements.
Raiko IT LLC cannot guarantee the integrity or availability of backups that are managed by third parties, client-maintained systems, or environments not under our direct administration.
Ultimate responsibility for data integrity, regulatory compliance, and data retention remains with the client.
7. Third-Party Services
We are not responsible for outages, changes, or failures of third-party platforms, vendors, ISPs, or manufacturers.
8. Unsupported Systems
We do not support end-of-life or unsupported hardware or software and are not responsible for issues arising from such systems.
9. Payments & Invoicing
Payments are invoiced separately. Failure to pay within thirty (30) days may result in suspension or termination of services.
Devices or equipment provided to Raiko IT LLC for service, repair, or evaluation will be released to the client upon receipt of payment for the services rendered.
Raiko IT LLC may retain possession of such devices until outstanding balances related to that work are paid in full. This policy applies only to the specific services performed on the device and is not intended to restrict access to client data beyond what is necessary to complete services.
10. Limitation of Liability
To the maximum extent permitted by law, Raiko IT LLC shall not be liable for indirect, incidental, or consequential damages. Liability is limited to fees paid for services.
11. Governing Law
These Terms are governed by the laws of the State of Colorado. Any disputes shall be brought exclusively in Colorado courts.
